Does the Justice of the peace have a legal right to not marry inter-racial couples?

I wonder if he feels the same with a black and asian or a latino etc..Does the Justice of the peace have a legal right to not marry inter-racial couples?
no, he does not. see ';Loving v. Virginia';, the 1971 SCOTUS decision that struck down anti-miscagenation laws.





this occurence is not as isolated a case as the conservatives would have you believe.





i really don't care how he feels. as a justice of the peace, an officer of the government, he has no right to bring his personal opinions into the execution of the duties of his office. wasn't that the conservative's primary objection to president obama's desire to choose federal jurists ';who have a sense of empathy';?





if conservatives wish to be once again taken seriously, they need to start living up to their own rhetoric. advocating a certain point of view and then abandoning it when it's applied to one's own self with the rationalization that ';but it's ok when they do it!'; is plain and simple hypocrisy.Does the Justice of the peace have a legal right to not marry inter-racial couples?
While I would support a pastors right (while not agreeing with it personally) to choose who he will marry, a Justice is an elected or appointed official and therefore is duly bound to uphold the laws of the citizenry whom he is appointed over. This man should immediately resign or be dismissed from this position (even if he did direct them to one who would marry them) for this racist stance. An elected official does not have the freedom to discriminate, but to serve all.
No. Really this isn't so much a race issue as it is one of legal jurisdiction. A judge is a representative of the law meant to interpret and enforce the laws of the legislature. This guy overstepped his bounds.





Also, his reasoning that the children of interracial marriages don't turn out well? Has he seen who's sitting in the oval office?
No, and it doesn't matter how he feels. Racial prejudice is merely one form of prejudice and injustice and I do sometimes think its 'elevation' to an 'unthinkable' ignores the many other kinds of prejudices that exist. However, no individual, whatever their private opinions, can exercise prejudice in performing governmental functions.
Depends on whether he has been issued a state license or not or whether there is even a requirement to have a state license.





If the state does issue a license for this profession, then no, he doesn't have the right to discriminate.





If the state doesn't issue a license, then unfortunately he can do whatever he pleases.
I think, legally, he has the same right to deny as any church does. That doesn't mean that the couple can't get married. It just means that he won't sign his name to the certificate.





Morally, on the other hand, he's what is commonly known as a ';douche-bag';.

No. It's illegal and he will be dismissed I guarantee you that. I am from Louisiana and this is not at all surprising. The only shocking thing is his blatant disregard for the rule of law. We all know about the closet racists in Louisiana and the ones who hide behind their sheets because of their self-loathing.
He feels the same about all mixing it was on the news... Right or wrong ( I am white and was married to a Pacific Islander) just go to the next JP and get a license from them- we may feel differently but others still have a right to their beliefs too.
If his position/license was issued by the state then NO he does not have that right. If it was NOT issued by the state then YES he does have that right.


The state cannot discriminate, the individual has the freedom to (even if others think it's wrong).
well I wouldnt feel comfortable with him bringing his on personal beliefs when he makes a judgement%26gt;he is supposed to up hold the constitution and the law...not make judgements based on his own personal beliefs and he needs to step down
No, he has made a legal mistake and his decision should be appealed.
No. If interracial marriages were against the law, then he can deny them the license.
